These terms and conditions, as may be amended from time to time, apply to all our services directly made available online, through any mobile device, by email or by telephone. By accessing, browsing, and using our website or any of our applications through whatever platform (collectively referred to as the “platform”) and/or by completing a reservation, you acknowledge and agree to have read, understood, and agreed to the terms and conditions set out below (including the privacy and cookies policy).

These pages, the content and infrastructure of these pages, and the online boat reservation service provided through the platform (the “service”) are owned, operated, and provided by Jffcharetrs.com, a.s., Pontoon  43, Dock 1 Fuq San L-Inkurunazzjoni, Cospicua, Malta. (“Jffcharters.com”, “us”, “we”, or “our”) and are provided for your personal, non- commercial use, subject to the terms and conditions set out below.  Obvious errors and mistakes (including misprints) are not binding.

1. Services

By booking through Jffcharters.com, you enter into a direct (legally binding) contractual relationship with JFF Charters from which you charter a boat.

2. Prices

Unless stated differently, all prices on the Jffcharters.com platform include:
 

• Rental of vessel for agreed timings

• A profesional crew

• Fuel for 30 nautical miles round trip

• Free flowing water, soft drinks and local beer

• Charcuterie board (cold cuts, cheeses, nuts etc)

• Fresh set of bed linen, toiletries and bath towels (applicable only for multi-day charters)

• Free use of masks and snorkels

• 400ltr supply of fresh water for showers and on board facilities
   

The following items are not included in the price:

• Local VAT (18%)

• Usage of SUP's  or other water toys unless otherwise stated

• Docking Fees [is applicable to clients who opt to visit a different Marina other then the home port]

• Extra fuel exceeding the 30 nautical miles (approx. €200 per hour according to given Market price at the time)

• Any additional food or beverages not including in the standard packages

• Use of tender

• Any damages caused to vessel or equipment

• Administrative Measures and Penalties or fines caused by guest/s

• Broker fee & commissions

• Gratuities

3. Seasons & Time

By making a reservation on our platform, you accept and agree to the given policy of season and time.

• Summer season begins on the 15th April and ends on the 15th September.

• Winter season begins 16th September and ends 14th April.

4. Payment.​

Jff Charters asks for the rental price to be paid partly to guarantee your reservation. You will be asked to guarantee your booking during the reservation process. A 30% deposit of the full amount will be therefore requested upon booking. Payment is safely processed from your credit/debit card or bank account to the bank account. The remaining balance shall be paid on the  day of the charter.

5.Cancellation

By making a reservation on our platform, you accept and agree to the relevant cancellation policy of JFF Charters and to any additional terms and conditions that may apply to your booking including services and/or products offered by the boat provider. 

All cancellations must be made at least 3 days prior to the reservation date. Failure to adhere to the terms and conditions will result in non eligibility to a refund of your deposit.

• 3-7 days prior one is eligible to 65% refund

• 8-15 days prior one is eligible to 75% refund

• 15 days + one is eligible to a full refund

excluding service fees and commissions if applicable.

Please note that a booking may be cancelled (without prior notice) if the full (remaining) booking amount cannot be collected on the payment date in accordance with the relevant payment policy of the booking. Late payment, wrong bank, debit or credit card details, invalid credit/debit cards, or insufficient funds are your responsibility. You shall not be entitled to any refund of any prepaid amount unless JFF Charters agrees otherwise in writing. 6.Legal & Policies

Without prejudice to applicable safety rules, passengers are not permitted to bring on board the Just For Fun vessels any of the following articles:

• any illegal drugs or controlled substance including non-prescribed narcotics

• firearms of all types, such as pistols, revolvers, rifles, shotguns

• compressed air and CO2 guns, such as pistols, pellet guns, rifles and ball bearing guns

• bows, cross bows and arrows

• slingshots and catapults

• devices for shocking, such as stun guns, tasers and stun batons

• disabling and incapacitating chemicals, gases and sprays, such as mace, pepper sprays, capsicum sprays, tear gas and acid sprays

• items designed for chopping, such as axes, hatchets and cleavers

• ice axes and ice picks

• box cutters

• martial arts equipment with a sharp point or sharp edge

• swords and sabres

• baseball and softball bats

• clubs and batons, such as billy clubs, blackjacks and night sticks

• fireworks and other pyrotechnics

• smoke-generating canisters and smoke-generating cartridges

• dynamite, gunpowder and plastic explosives

Without prejudice to applicable safety rules, passengers are held fully responsible for their behaviour and will held legally responsible for any breach of any local laws such as:

• Public nudity 

• Disturbance of peace

• Drunk and disorderly behaviour

• Physical altercations

• Material damages to property or any form of bodily harm

Without prejudice to applicable safety rules legal actions will be taken in the case of misconduct of guest/s:

• Administrative Measures and Penalties or fines caused by guest/s shall be bourne by said guest/s including but not limited to any consequential loss

• No guest is allowed to drive any vessel or tender other than the official JFF Crew.

 

7. Agreement

By completing a reservation, you agree to receive (i) an email from us, giving you information on your booking and providing you with certain information and offers relevant to your booking and destination, and (ii) an email which we send to you after finishing your booking, inviting you to leave your review.

7.Reviews

Your review may be uploaded onto Jffcharters.com testimonial section on our platform for the purpose of informing (future) customers of your opinion of the quality. We reserve the right to adjust, refuse, or remove reviews at our sole discretion.

8.Correspondence

Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid, or incurred due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation email (whether for one event or series of connected events).

JFF Charters is not liable for any direct, indirect, consequential, or punitive loss or damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of Jffcharters.com; or (v) any injury, death, property damage or other (direct, indirect, consequential, or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, wilful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the service provider or any of whose products or service are (directly or indirectly) made available, offered, or promoted on or through the platform, including any cancellation, overbooking, strike, force majeure, or any other event beyond our control.
